On August 28, 2012, the Company issued a press release announcing that the National Labor Relations Board (the "NLRB") conclusively dismissed IBEW Local Union 1357's unfair labor practices charge relating to the January 1, 2012 implementation by Hawaiian Telcom, Inc., an indirectly wholly-owned subsidiary of the Company, of the employment terms in its last, best and final offer. A copy of the press release announcing the conclusive dismissal is attached hereto as Exhibit 99.1.
