Item 1.04 Mine Safety - Reporting of Shutdowns and Patterns of Violation
On August 16, 2012, Sidney Coal Company, Inc., a subsidiary of Alpha Natural
Resources, Inc., received an imminent danger order issued by the Mine Safety and
Health Administration ("MSHA") under section 107(a) of the Federal Mine Safety
and Health Act of 1977 alleging that an employee was observed in the red zone of
a continuous miner in the Process Energy mine, located in Sidney, Kentucky. No
injuries occurred in connection with the cited condition, and employees at the
mine have been provided additional training regarding red zone awareness.
