On August 6, 2012, the Company issued a press release (attached hereto as Exhibit 99.1) entitled 'Bion Announces Approval of New Canadian Patent' and has placed the press release on its website: www.biontech.com.
On August 7, 2012 the Company delivered a performance data report to the Pennsylvania Infrastructure Investment Authority ('Pennvest') regarding the operations of Bion's waste treatment system located at the Kreider Dairy Farm in Manheim, PA ('Kreider System') which documents that the nitrogen ('N') and phosphorus ('P') reduction efficiency achieved by the Kreider System exceeds the 'Performance Standard' (removal of 70% of N and 75% of P) set forth in the Funding Agreement with Pennvest and thereby met the 'Technology Guaranty' set forth in such agreement.
