On October 20, 2009, the United States Court of Appeals for the Tenth Circuit denied Novell, Inc.'s petitions for rehearing or for rehearing en banc of the Court's opinion issued on August 24, 2009. In its order, with respect to the petition for rehearing en banc, the Court stated,: "As no member of the panel and no judge in regular active service on the court requested that the court be polled, that petition is also denied."
