On October 15, 2009, SMF Energy Corporation (the "Company") issued a press release announcing that it received a letter from Nasdaq confirming that the Company has reestablished compliance with Nasdaq Marketplace Rule 5450(a)(2), requiring a $1 minimum closing bid price. A copy of this press release is attached hereto as Exhibit 99.1 and is incorporated by reference herein.
