Item 8.01 Other Events.
On October 1, 2009, FreightCar America, Inc. (the "Company") received notification from the Nasdaq Stock Market ("Nasdaq") stating that based on the filing of the Company's Form 10-Q for the period ended June 30, 2009, the Company is in compliance with Nasdaq Marketplace Rule 5250(c)(1). Nasdaq had notified the Company on August 19, 2009 that the Company was not in compliance with Nasdaq Marketplace Rule 5250(c)(1) due to the delayed filing of its quarterly report on Form 10-Q for the quarter ended June 30, 2009 A copy of the Nasdaq notification received by the Company is attached as Exhibit 99.1 to this Current Report on Form 8-K and is incorporated herein by reference.
