On July 1, 2009, Kevin R. Collins informed the Board of Directors of Evergreen Energy Inc. that he will retire from the Board and a member of the Executive Committee effective immediately.

The Board, at its discretion, has decided to not fill this vacancy at this time.

On July 6, 2009, the Company issued a press release announcing Mr. Collins' resignation from the Board. A copy of the press release is attached hereto as Exhibit 99.1 and is incorporated herein by reference.
