On April 8, 2009, Pacific Mercantile Bancorp announced its decision not to participate in the U.S. Treasury Capital Purchase Program under the Troubled Asset Relief Program (TARP). The Company had announced on February 19, 2009 that they had been preliminary approved by the U.S. Treasury Department to take part in the TARP program and was eligible to obtain a capital investment of up to $25.5 million from the U.S. Treasury. Attached as Exhibit 99.1 to this Report is a copy of that press release, which qualifies in its entirety the foregoing summary of that press release.
