This Current Report on Form 8-K/A is being filed for the purpose of refiling the Company's press release announcing its financial results for the year ended December 31, 2008. A copy of the press release containing the announcement is furnished as Exhibit 99.1 to this report on Form 8-K/A.
The press release included as Exhibit 99.1 to the Current Report on Form 8-K filed on February 5, 2009, and subsequently amended by a Current Report on Form 8-K/A filed on February 13, 2009, contained incorrect income tax expense and net loss information due to a material weakness in the Company's internal controls and procedures related to the Company's deferred income taxes, which was discovered subsequent to the issuance of the Company's earnings release. This material weakness resulted in a decrease in income tax benefit and an increase in net loss of approximately $12 million.
