Item 3.01. Notice of Delisting or Failure to Satisfy a Continued Listing Rule or Standard; Transfer of Listing

On November 25, 2008, Dynavax Technologies (the "Company") announced that the Nasdaq Listing Qualifications Staff (the "Staff") has approved the Company's request to transfer the listing of its shares to The Nasdaq Capital Markets from The Nasdaq Global Market, effective at the open of the market on Wednesday, November 26, 2008.
