On November 24, 2008, BreitBurn Energy Partners L.P. (the "Partnership") filed its Original Answer (the "Answer") and Special Exceptions (the "Special Exceptions") in response to the Quicksilver Resources Inc. lawsuit that was previously filed in the District Court of Tarrant County, Texas, 48th Judicial District. A copy of each of the Answer and the Special Exceptions are attached hereto as Exhibit 99.1 and Exhibit 99.2, respectively, and are incorporated herein by reference.
