(d) On July 10, 2008, the KB Home board of directors elected Mr. Robert L. Johnson as a director for a term ending on the date of the Company's 2009 Annual Meeting of Stockholders. Mr. Johnson's election was reported on a Form 8-K filed on that date. At the time of Mr. Johnson's election, a decision regarding his appointment to one or more board committees was expected to be made at the board's next regularly scheduled meeting.

On October 2, 2008, the board appointed Mr. Johnson to its Audit and Compliance Committee, effective immediately.
